Arbitration Agreement Scope
Acknowledging the significant expenses associated with legal conflicts, both you and CountryClad.com agree to settle any legal disputes related to these Terms, purchases, communications, or your involvement in any CountryClad.com service through binding individual arbitration, unless you opt out as described below. This agreement implies a waiver of your right to initiate or defend your rights in court, though you or CountryClad.com may bring individual claims in small claims court within the allowed limits. The term “dispute” is broadly defined to encompass disagreements, actions, claims, or controversies of any nature between you and CountryClad.com.
Informal Resolution of Disputes
Any party initiating a dispute must first attempt resolution through written notice, detailing the facts and allowing 30 days for a response. Notices to CountryClad.com should be sent to CountryClad.com, Attn: Customer Service, [Your Address Here], and to you at your address registered with CountryClad.com. This step is a mandatory precondition to proceeding with arbitration.
Right to Opt Out of Arbitration
You have the option to opt out of this Arbitration Agreement within the first 30 days after your initial purchase or subscription to a CountryClad.com service. Opt out by emailing service@countryclad.com or sending a letter to CountryClad.com, Attn: Customer Service, [Your Address Here], with your name, mailing address, and a statement indicating your decision to “Reject Arbitration.”
Arbitration Procedure
Arbitration will be overseen by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as modified by this Arbitration Agreement. Arbitration hearings will be held in your county of residence. For non-US residents, arbitration will occur in the USA. CountryClad.com will bear the costs for non-frivolous claims, except as determined by the arbitrator.
Class Action Waiver
Arbitration will proceed individually. You and CountryClad.com agree to forgo any class action lawsuit or arbitration, private attorney general lawsuit, or any joint or consolidated lawsuit or arbitration. If deemed invalid, such actions must be pursued in a court of proper jurisdiction.
Governing Law and Additional Terms
This Arbitration Agreement is governed by the Federal Arbitration Act and other federal laws. State law may apply where relevant, based on your residential address. Arbitrators will determine the scope and enforceability of this Agreement. Any portion of this Agreement found invalid will not affect the remainder. This Agreement persists even after your relationship with CountryClad.com ends.
